Provisions on the administration of food labeling

Chapter I General Provisions

Article 1 in order to strengthen the supervision and administration of food labeling, standardize the labeling of food labeling, prevent quality fraud, and protect the legitimate rights and interests of enterprises and consumers, according to the product quality law of the people's Republic of China and the food hygiene law of the people's Republic of China These Provisions are formulated in accordance with the special provisions of the State Council on strengthening the supervision and administration of food and other product safety and the regulations of the people's Republic of China on the administration of production licenses for industrial products and other laws and regulations

Article 2 These Provisions apply to the labeling and management of food produced (including repackaged) and sold within the territory of the people's Republic of China

Article 3 the term "food identification" as mentioned in these Provisions refers to the general term of words, symbols, numbers, patterns and other descriptions pasted, printed and marked on food or its packaging to indicate the name, quality grade, quantity of goods, method of eating or using, producer or seller and other relevant information of food

Article 4 the General Administration of quality supervision, inspection and Quarantine (hereinafter referred to as the General Administration of quality supervision, inspection and Quarantine) is responsible for organizing the supervision and administration of food labeling throughout the country within its scope of authority

the local quality and technical supervision departments at or above the county level shall be responsible for the supervision and management of food labeling within their respective administrative areas within their terms of reference

Chapter II marking contents of food labels

Article 5 food or its packaging shall be attached with labels, except for food that may not be attached with labels according to laws and administrative regulations

the contents of food labels should be true, accurate, easy to understand, scientific and legal

Article 6 the food label shall indicate the name of the food

the name of the food shall indicate the true attributes of the food and meet the following requirements:

(I) if the national standards and industrial standards have provisions on the name of the food, the name specified in the national standards and industrial standards shall be adopted

(2) if there are no provisions on food names in national standards and industrial standards, common names or common names that will not cause misunderstanding and confusion among consumers shall be used

(3) when new names, peculiar names, transliterated names, brand names and other names that are easy to misunderstand the properties of food, such as materials, regional slang names or brand names that can make the sticky substances combine together, a name or classification (generic) name specified in items (1) and (2) of this article shall be marked with the same font size in the adjacent parts of the name shown

(4) the name of a food that is physically mixed from two or more kinds of food and is uniform in appearance and difficult to separate from each other shall reflect the mixing attribute and classification (generic) name of the food

(V) for food made of animal and plant food with specific processing technology to imitate the characteristics of individuals, organs, tissues and other organisms, the words "artificial", "imitation" or "plain" shall be prefixed with the name, and the classification (category) name of the real attribute of the food shall be marked

Article 7 food labels shall indicate the origin of the food

Article 8 the name and address of the producer shall be marked on the food label. The name and address of the producer shall be the name and address of the producer who is legally registered and can bear the product quality

(1) the company or its subsidiaries that independently undertake the law according to law shall mark their respective names and addresses

(2) for a company branch or production base that cannot independently undertake the law according to law, the name and address of the company and the branch or production base shall be marked, or only the name and address of the company shall be marked

(III) if the entrusted production and processing of food is not responsible for external sales, the name and address of the entrusted enterprise shall be marked; For the food subject to production license management, if the entrusting enterprise has its food production license for entrusted processing, it shall mark the name and address of the entrusting enterprise and the name of the entrusted enterprise, or only the name and address of the entrusting enterprise

(4) repackaged food shall be marked with the name and address of the repackaging person and the words of repackaging

Article 9 food labels shall clearly indicate the production date and shelf life of the food

if the shelf life of food is related to storage conditions, the specific storage conditions of food shall be marked. Beverages, wines, vinegar, edible salt and solid sugar with alcohol content of more than 10% (including 10%) can be exempted from the shelf life

the marking method of date shall comply with the provisions of national standards or be expressed by year, month and day

Article 10 the label of quantitatively packaged food shall indicate the net content. For food containing solid and liquid substances, in addition to the net content, it should also indicate the content of drained matter (solids)

the net content should be listed on the same display page as the food name. The marking of net content shall comply with the provisions of the measures for the supervision and administration of measurement of quantitatively packed commodities

Article 11 food labels shall indicate the list of ingredients of food

various ingredients in the ingredients list shall be marked in the descending order of the amount added during the production and processing of food, and the specific marking method shall be implemented in accordance with the provisions of national standards

if sweeteners, preservatives and colorants are directly used in food, specific names shall be marked under food additives in the ingredients list; If other food additives are used, the specific name, type or code may be marked. The scope and amount of food additives shall be implemented in accordance with the provisions of national standards

Article 12 food labels shall be marked with the national standard, industrial standard, local standard number implemented by the enterprise or the enterprise standard number that has been filed

Article 13 if the standards for food implementation clearly require that the quality grade and processing technology of food be marked, they shall be marked accordingly

Article 14 for the food subject to production license management, the food label shall be marked with the food production license number and QS mark

Article 16 in case of any of the following circumstances, the label of a food shall be marked with a description in Chinese:

Article 17 If a food is marked with the words "nutrition and fortification" in its name or description, it shall be marked with the nutrients and calories of the food in accordance with the relevant provisions of the national standards, and comply with the quantitative indications specified in the national standards

Article 18 food labels shall not be marked with the following contents:

(1) express or imply that it has the effect of preventing and treating diseases

(2) non health food has an explicit or implied health care effect

(3) describing or introducing food in a deceptive or misleading manner

(4) the additional product description cannot prove its basis

(5) words or patterns do not respect national customs and have discriminatory descriptions

(6) using the national flag, national emblem or RMB for marking

(VII) contents prohibited by other laws, regulations and standards

Article 19 the following illegal acts of food labeling are prohibited:

(1) forging or falsely marking the production date and shelf life

(2) forging the origin of food, forging or falsely using the name and address of other producers

(III) forge, falsely use or alter the logo and number of the production license

(IV) other behaviors prohibited by laws and regulations

Chapter III marking form of food labeling

Article 20 food labeling shall not be separated from food or its packaging

Article 21 food labels shall be directly marked on the food of the smallest sales unit or its packaging

Article 22 If the package of a sales unit contains different varieties of food with multiple independent packages, the food identification of each independent package shall be marked in accordance with this regulation

if all or part of the mandatory marking contents of each independently packaged food cannot be clearly identified through the outer packaging of the sales unit, they shall be marked on the outer packaging of the sales unit respectively, except that the outer packaging is easy to open and identify; If it can clearly identify all or part of the mandatory marking contents of each independently packaged food, it is not necessary to mark the corresponding contents on the outer package repeatedly

Article 23 food labels should be clear and eye-catching, and the background and background color of the labels should adopt contrast colors, so that consumers can easily recognize and read

Article 24 the words used in food labeling shall be standard Chinese, except for registered trademarks

food labels can use Chinese pinyin or minority characters at the same time, and can also use foreign languages at the same time, but it should have a corresponding relationship with Chinese, and the foreign language used should not be greater than the corresponding Chinese, except for registered trademarks

Article 25 when the maximum surface area of food or its packaging is greater than 20 square centimeters, the height of the words, symbols and numbers of the mandatory contents in the food label shall not be less than 1.8 mm

when the maximum surface area of food or its packaging is less than 10 square centimeters, its identification can only indicate the food name, manufacturer's name and address, net content, production date and shelf life. However, if laws and administrative regulations provide that they should be marked, their provisions shall prevail

Chapter IV law

Article 26 If the food or its packaging is not marked in violation of the first paragraph of Article 5 of these Provisions, it shall be ordered to make corrections within a time limit and be fined not more than 10000 yuan

Article 27 those who violate articles 6 to 8 and 11 to 13 of these provisions and fail to mark the contents that should be marked as required shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be fined not less than 500 yuan but not more than 10000 yuan

Article 28 those who violate Articles 9 and 15 of these regulations and fail to mark the production date and shelf life, warning signs or warning instructions in Chinese as required shall be punished in accordance with Article 54 of the product quality law of the people's Republic of China

Article 29 those who violate Article 10 of these provisions and fail to mark the net content as required shall be punished in accordance with the provisions of the measures for the supervision and administration of the measurement of quantitatively packed commodities

Article 30 if the food subject to production license administration is not marked with the production license number and mark, it shall be punished in accordance with Article 47 of the regulations of the people's Republic of China on the administration of production licenses for industrial products

Whoever forges, falsely uses or alters the number and mark of the production license shall be punished in accordance with Article 51 of the regulations of the people's Republic of China on the administration of production licenses for industrial products
